Do police have to read Miranda rights during a Florida traffic stop?
Usually not. Miranda warnings are not required at every arrest or traffic stop. As Sabrina explains, Miranda applies when three things line up: you are in custody, there is an interrogation, and the questioning is reasonably likely to elicit an incriminating response. A routine traffic stop typically does not meet that test, so the absence of a warning is not, by itself, a defect in the case. Either way, the safer move is to stay quiet.

Hey everyone. It's Sabrina the DUI Gyal here to drop a video on your Thursday afternoon and make up for some lost time because I know it's been a while. I want to talk about something I've been hearing so much recently and that's regarding Miranda. I hear it all the time like, "Oh, I got arrested but the police officers didn't Mirandize me." And surprise, the police officers don't necessarily have to Mirandize you especially if it's a traffic stop. The only times Miranda will apply is if one, you're in custody, two, there's going to be an interrogation, and three, if the interrogation is going to reasonably solicit a self-incriminating response. And while we're on the subject, I just want to remind everybody if you find yourself in a situation where with a police officer, they're trying to ask you questions, just be quiet because everything you say can and will be used against you.
