Should I tell police about medical conditions before field sobriety exercises?

If a condition could affect your ability to perform, say so. In a DUI pre-screening, officers are supposed to ask about where you are coming from, what you have had to drink, and whether you have injuries — questions meant to rule out non-impairment explanations for poor coordination. People routinely forget to mention a back or neck injury, a foot problem, or vertigo. Raising it at the time preserves the explanation instead of leaving performance to speak for itself.

Welcome one, everybody. It's Sabrina, the DUI Gyal from NCNJ Law. Here to drop a video on your Friday. So, today I want to talk about DUIs and the pre-screening investigation. What should happen in a DUI investigation is that law enforcement should be asking questions like, oh, where are you going? Have you had something to drink? Do you have injuries? And the reason why they ask these questions is to eliminate any reason why somebody may not be able to perform on some of these coordinated exercises. And sometimes clients don't think to say, oh, I have a back injury, or I have a neck injury, or I have vertigo, or whatever it may be, that would ultimately affect their performance. So, if you find yourself in a situation like that and let's say you had a back injury from like 10 years ago, or maybe like a foot injury, say it. If you have something that could potentially affect your ability to perform, say it. Even as something like, oh, my head hurts because I had to listen to somebody complain about something. You never know. Hope this helps.
